Driving without a license in Wisconsin: ticket or crime?

Thousands of people in Wisconsin drive without a valid license because they cannot get one or because they lost it. When police stop them, the citation can look like just another ticket. It is not always. The answer depends on why you have no license and how many times it has happened.

Three different situations

  • You have never had a Wisconsin license. The first time is usually treated as a violation with a fine. Repeating it can bring larger penalties.
  • Suspended license. A suspension usually comes from unpaid tickets, points, or an administrative suspension. Driving while suspended is a violation, and each citation can extend the suspension.
  • Revoked license. A revocation is more serious and usually comes from an OWI or repeat offenses. Driving while revoked can be a criminal charge, with possible jail time, especially when repeated.

If you are not sure which situation you are in, the DMV can give you your driving record. It is worth getting it before you go to court.

Municipal court or county court

Many traffic citations go to the municipal court of the city where you were stopped. More serious charges go to the county circuit court. Either way, you have to appear. If you do not, the court can rule against you and add another suspension. Lugo Law LLC appears in the Milwaukee, Racine, Kenosha, and Waukesha courts.

Why it matters even if it is "just a ticket"

  • Every citation goes on your driving record and raises your insurance cost.
  • Unpaid fines produce new suspensions, and the problem grows.
  • For a person who is not a U.S. citizen, a record of arrests and citations can come up in immigration applications, even without a criminal conviction.

What to do

  1. Read the citation and write down the court date.
  2. Request your driving record from the DMV.
  3. Gather proof that you are fixing the problem: fine payments, a road test appointment, insurance.
  4. Talk to an attorney before the court date. In many cases there are options to reduce the penalty or avoid a new suspension.
